Waiver and Release of Liability and Claims
Participants in the Fred North Helicopter Safety Mentorship Program (hereafter “Mentorship Program”) acknowledge, understand and agree to the following:
that I am participating in the Mentorship Program of my own free will and accord, and that such participation is strictly voluntary;
that the mentorship received by me as part of the Mentorship Program is for educational purposes only and does not constitute flight instruction or advice;
that the program organizers, Mentors and/or associated entities are not responsible for any injuries, damages, or losses sustained by participants and/or third parties flying with them during the Mentorship Program;
that flying is inherently risky, and I agree to assume all risks associated with flying, and also agree that the Mentor's advice should not be considered a substitute for my professional training and/or decision-making in actual flight situations;
that the pilot-in-command of any flight has the ultimate responsibility for all flight safety and decisions;
that reliance on any information provided by any Mentors, participants, or others assisting with the Mentorship Program is solely and completely at my own risk;
that the information provided to me by the Mentors associated with the Mentorship Program is strictly voluntary and not independently validated, recommended, or verified, and thus I should not use any materials, methods, information, techniques, opinions or procedures expressed, presented or demonstrated by the Mentors without first evaluating my own needs and circumstances and exercising my own professional judgement with respect to piloting and/or flight safety.
Further, to the maximum extent permitted by applicable law, in consideration for my participation in the Mentorship Program and the mentoring that I receive, I hereby release the program organizers, mentors and/or associated entities from any liability arising from their participation in the Mentorship Program, and/or from any flight decisions, injuries, damages and losses sustained by me and/or third parties flying with me during the Mentorship Program.
Further, to the maximum extent permitted by applicable law, in consideration for my participation in the Mentorship Program and the mentoring that I receive, I waive any and all rights or claims, causes of action that I may have against the Mentorship Program, the program organizers, Mentors, and/or associated entities, as well as their employees, members, staff and/or individuals assisting with the Mentorship Program, and I agree to release the program organizers, Mentors, and/or associated entities, as well as their employees, members, staff and/or all individuals assisting with the Mentorship Program, from any and all liability for any claims and/or injuries and/or damages of any kind, including direct, indirect, special, punitive, incidental, exemplary, contractual, or consequential damages (including but not limited to attorneys’ fees and costs), resulting from or arising out of or in any manner connected with my participation in the Mentorship Program and/or use of any advice provided by Mentors as part of the Mentorship Program.
Further, to the maximum extent permitted by applicable law, I agree to indemnify, defend, and hold harmless the program organizers, Mentors and/or associated entities, as well as their employees, members, staff and all individuals assisting with the Mentorship Program, from any and liability, loss, claim, damages and/or expenses (including but not limited to reasonable attorneys' fees) arising from my participation in the Mentorship Program and/or the use of any advice received by me from the Mentors.
